Sensors and Testing Monthly may delete or destroy any such User Content anytime. Sensors and Testing Monthly is not responsible for any end-user’s misuse or misappropriation of any user content or information you post on Sensors and Testing Monthly.

LICENSE TO USER CONTENT

All User Content must comply with these Terms. By submitting, transmitting, or displaying your User Content on or through Sensors and Testing Monthly, you automatically grant (and you represent and warrant that you have the right to grant) Sensors and Testing Monthly, its licensees, and their respective successors and assigns, officers, directors, employees, licensees, agents, and representatives, a worldwide, sublicensable, assignable, perpetual, irrevocable, non-exclusive, royalty-free, unlimited right and license to use, reproduce, publish, distribute, publicly display and perform, reformat, adapt, modify and delete your User Content in connection with Sensors and Testing Monthly via any or all media, platforms and formats whether now or later known or developed (“License”).

REPRESENTATION OF OWNERSHIP

FEEDBACK AND IDEA SUBMISSIONS

Sensors and Testing Monthly does not accept unauthorized idea submissions. Any ideas shared with Sensors and Testing Monthly are not confidential. Sensors and Testing Monthly may develop, use, and freely disclose or publish similar ideas without compensating you or accounting to you. All comments or materials submitted to us, including testimonials, images, reviews, questions, comments, or suggestions (collectively, “Feedback”), are received and treated by us on a non-confidential and unrestricted basis.

If you provide Sensors and Testing Monthly with any Feedback, you hereby grant Sensors and Testing Monthly a non-exclusive, fully-paid, royalty-free, irrevocable, perpetual, transferable, sublicensable license to reproduce, distribute, modify, prepare derivative works based on, publicly perform, publicly display, make, have made, use, sell, offer to sell, import, and otherwise exploit that Feedback for any purposes, for all current and future methods and forms of exploitation throughout the world. If any such rights may not be licensed under Applicable Laws (such as moral and other personal rights), you hereby waive and agree not to assert all such rights. You understand and agree that Sensors and Testing Monthly is not required to use any Feedback you provide.

You agree that if Sensors and Testing Monthly uses your Feedback, Sensors and Testing Monthly is not required to credit or compensate you for your contribution. You represent and warrant that you have sufficient rights in any Feedback you provide to Sensors and Testing Monthly to grant Sensors and Testing Monthly and other affected parties the abovementioned rights. This includes but is not limited to intellectual property rights and other proprietary, privacy, or other personal rights.

OWNERSHIP OF CONTENT AND MARKS

Sensors and Testing Monthly, and all content published on or accessible through Sensors and Testing Monthly (including, for example, audio, photographs, illustrations, graphics, other visuals, video, copy, text, software, titles, Shockwave files, etc.), code, data and materials thereon, the look and feel, design and organization of the website, and the compilation of the content, code, data and materials on Sensors and Testing Monthly (“Content”), is owned by Sensors and Testing Monthly, its subsidiaries, affiliates or its licensors, and is protected by laws governing copyrights, moral rights, sui generis rights, patents, trademarks, trade secrets or other proprietary rights.

By accessing and using this site, you acknowledge and understand that Sensors and Testing Monthly sends to its opt-in subscribers, prospects, and contacts lists a series of newsletters and email marketing campaigns as a regular ongoing part of its service offering. These emails contain industry news, advertising and promotional materials, and direct marketing campaign content. Such material is sent to the opt-in subscriber lists of Sensors and Testing Monthly using the Mailchimp third-party email marketing software platform. At any time, for any reason, or no reason whatsoever, opt-in subscribers to Sensors and Testing Monthly may choose to “unsubscribe” from such email correspondence by using the link at the end of each MailChimp-generated email.  They may also contact us directly to request such removals. Sensors and Testing Monthly will process any such requests for removals within five (5) business days.

Sensors and Testing Monthly collects from each contact or new form submission only the personal information from each end-user that is strictly necessary to maximize our website’s end-user benefits. All data collected by Sensors and Testing Monthly is stored, does not expire, is kept confidential, will not be shared with third parties, and its collection, storage, and use are governed by our website Privacy Policy and these Terms of Use.

DCMA NOTICE (U.S. ONLY) – FILING A COMPLAINT

If you are a user based in the United States, Sensors and Testing Monthly has designated an agent to act on behalf of the publication on an as-needed basis and in accordance with the terms of the Digital Millennium Copyright Act (“DMCA”) and avails itself of the protections under the DMCA.

Sensors and Testing Monthly reserves the right to remove any User Content on Sensors and Testing Monthly that allegedly infringes another person’s copyright. We are not obligated to scan such posted content for any violations of third-party rights. FILING A DCMA COUNTER TAKEDOWN NOTICE

If your material has been removed or blocked by us as a result of our receipt of a DMCA Takedown Notice, you may send us a request asking for the allegedly infringing material to be restored in the form of a written letter sent by United States regular mail only (“DMCA Counter-Notice”), and with content that includes, at a minimum:

  • Identification of the copyrighted work (or works) that Sensors and Testing Monthly removed and the URL on the com website, with the location at which the works had previously appeared before they were removed. The information you provide must be reasonably sufficient to permit us to identify the copyrighted work;
  • Your full legal name, address, telephone number, and email address (if available);
  • A statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located or the State of New York if your address is outside of the United States.
  • A statement that you will accept service of process from the person (or an agent of such person) who provided the DMCA Takedown Notice.
  • A statement that you have a good faith belief that the allegedly infringing material identified above as the copyrighted work was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled; and
  • A full legal signature of a person authorized to act on behalf of the owner of the copyrighted work that was removed.

When Sensors and Testing Monthly receives the DMCA Counter-Notice, we will send a copy to the party who originally sent us the DMCA Takedown Notice requesting the removal of the allegedly infringing material on Sensors and Testing Monthly. We will then reinstate the allegedly infringing material unless that party obtains a court order supporting the removal of the allegedly infringing material.

In addition to the above, Sensors and Testing Monthly reserves the right to ignore a DMCA Counter-Notice that does not comply with the DMCA. Both the DMCA Takedown Notice and the DMCA Counter-Notice must be sent to our designated DMCA designated agent addressed as follows:

CHANGES TO WEBSITE TERMS OF SERVICE

REFUND POLICY

Since Sensors and Testing Monthly offers non-tangible, irrevocable digital goods, we issue refunds on a case-by-case basis only. Refunds must be requested in writing within ten (10) calendar days of the booking or purchase order, whichever date is sooner.
